Our client, a licensed repossession agent, was following a stolen vehicle in an attempt to repossess it for a local auto dealership.  The Clackamas County DA charged our client with Reckless Driving and Reckless Endangement on the cockamamie theory that by following the stolen vehicle, our client was responsible for making the operator of the stolen vehicle drive recklessly, endangering himself and his passenger.  Megan McVicar argued that our client’s conduct in following this vehicle did not make its driver commit these crimes when he tried to get away.  A Clackamas County jury agreed with Ms. McVicar, and quickly returned a verdict of not guilty on all three counts.
