On September 25, 2025, the Oregon Supreme Court reversed our client’s Kidnap II conviction, finding that the trial court should have granted the defense’s motion for judgment of acquittal. The client was accused of dragging his wife out of the house and not letting her back in for 10 minutes.The Court found that “no reasonable factfinder could find that defendant had moved [alleged victim] from ‘one place to another’ as that phrase is used in the second-degree kidnapping statute.” Client had been sentenced to 70 months on this Measure 11 conviction, and the Supreme Court’s reversal resulted in the dismissal of the conviction and his immediate release from prison.
